These Terms of Service ("Terms") govern your access to and use of the FitScript platform, operated by FIT SCRIPT LLC, a limited liability company organized under the laws of the State of Florida, USA, with offices at 321 Victoria Trails Blvd, DeLand, FL 32724, United States.

By creating an account or using FitScript, you agree to be bound by these Terms. If you are using FitScript on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify FitScript immediately of any unauthorized use of your account. FIT SCRIPT LLC is not liable for losses arising from unauthorized access to your account.

Acceptable Use

You agree to use FitScript only for lawful purposes related to strength training programming, athlete management, and fitness coaching. You may not use the platform to distribute harmful content, reverse-engineer the AI models, or resell access without authorization.

Subscription and Billing

FitScript offers monthly and annual subscription plans. Fees are billed in advance and are non-refundable except as required by law. You may cancel your subscription at any time; access continues until the end of the current billing period. FIT SCRIPT LLC reserves the right to modify pricing with 30 days' notice.

Intellectual Property

All content, algorithms, and technology underlying FitScript are the property of FIT SCRIPT LLC. Training programs generated by the AI are licensed to you for personal or coaching use. You retain ownership of any data you input into the platform.

Limitation of Liability

FitScript provides AI-generated training recommendations. These are not a substitute for professional medical advice. FIT SCRIPT LLC is not liable for injuries resulting from following generated programs. Users should consult healthcare professionals before beginning any training program.

FIT SCRIPT LLC ("we," "us," "our") is committed to protecting the privacy of users of the FitScript platform at fitscript.org.

Information We Collect

We collect information you provide directly: name, email address, training history, body metrics, and performance data. We also collect usage data including session logs, feature interactions, and device information. If you connect wearable devices, we receive recovery metrics such as HRV, sleep data, and resting heart rate.

How We Use Your Data

Your data is used to generate personalized training programs, adapt plans based on recovery signals, provide coaching analytics, and improve our AI models. We do not sell personal data to third parties. Aggregated, anonymized data may be used for research and product improvement.

Data Security

We implement industry-standard security measures including encryption in transit and at rest, access controls, and regular security audits. Our infrastructure is hosted on SOC 2 compliant cloud providers within the United States.

Your Rights

You may request access to, correction of, or deletion of your personal data at any time by contacting privacy@fitscript.org. Colorado residents have additional rights under the Colorado Privacy Act, including the right to opt out of data processing for targeted advertising.

Data Retention

We retain your data for as long as your account is active. Upon account deletion, personal data is removed within 30 days, except where retention is required by law or for legitimate business purposes.
